The Log Cabin Republicans of Tennessee have announced their formal opposition to House Bill 1472 and Senate Bill 1745, collectively known as the “Banning Bostock Act.”
The group said the legislation represents unnecessary government overreach that could threaten Tennessee’s business environment and violate conservative principles. According to a statement on their website, “While we share our colleagues’ commitment to state sovereignty, this legislation represents an unnecessary government overreach that threatens Tennessee’s business-friendly environment and violates core conservative principles.”
The organization said that Tennessee is currently an “at-will” employment state, where employers have broad authority in managing their workforce as long as civil rights are not violated. The group argued that HB 1472 is a legislative overcorrection to a problem they say does not exist in the state. They said, “By carving out a complex, state-specific exception for ‘sex discrimination,’ it adds bureaucratic confusion for small business owners. Our party champions less regulation, not new legal hurdles that require checking multiple statutes for routine decisions.”
The Log Cabin Republicans also raised constitutional concerns about the bill’s directive for Tennessee courts to ignore the U.S. Supreme Court’s decision in Bostock v. Clayton County (2020), which held that federal protections against sex discrimination under Title VII include sexual orientation and gender identity. They said, “States cannot simply legislate away Supreme Court interpretations of federal law. This bill invites federal preemption challenges, wasting taxpayer dollars on doomed litigation and creating legal uncertainty for Tennessee businesses.” The group added that true conservatism should safeguard individual liberty and property rights without additional state interference.
